whos at fault?

ok so during my spring break i was leaving a gas station...and i start backing up and some douche bag comes flyin in the lot and stops right behind me and i hit him...first thoughts i thought i was at fault and i didnt want to deal with some cops so i told him to get me a estimate and call me...couple days later he gives me a estimate of 1100 dollars and mind you his car isnt worth 5 dollars but anyway...

After he left the gas station that night i went back inside and a couple people were in there and they were like what was said so i told em...they all said i was already backing up and that he was deffinatly speeding as he came in and that he is at more fault than i am

and for those that are wondering what happened to my car? i caught his mirror so really all that happened to my car was a nice dent in the curve of the top of my trunk...my friends step dad popped it out the next day and all thats left to do is mud it and spray it

i'd say it's his fault. you were in the lot, he wasn't. people in a space have priority over people who aren't..

no i wasnt pumpin gas...inside a bud was workin
yes i looked behind me...i looked started backing up and than as i started backing up he pulled in (speeding might i add) cuz the kid drives like a dumbass and musta saw me backin up and for some reason stopped

more than likely they will call you as being at fault since A. you dont have witnesses, and B. you were the only car to be moving at the time of the collision.

Had he come out of a blind, and nailed you with a witness near it would have been his fault since he was seen moving. Its his word against yours, for all you know he could have ripped on his horn for 5 mins and you didnt stop.. ya know.

Just make a sketch of how it happened and take the asshole to court if your confident in you being right.

in NYS, if you hit someone anywhere from the edge of the door, back, you're at fault. the exception is if they intentionally reverse into you, and you can prove it. plus, the guy has witnesses, everyone in the gas station...

as long as your witnesses pull through its all good, only falls through as long as they have the same story as you.

if he was stopped when you hit him you're going to be at fault.

if he was stoped and you hit him.. sorry to tell you but you are at fault... you might have glanced back but didnt keep your sight looking back..
